Parking Fines privacy notice

Please note: the following notice provides additional privacy information to the Rochdale Borough Council privacy notice.

The Parking Prosecutions team has the responsibility of enforcing on street parking and some off street parking areas restrictions, including car parks we operate. Penalty Charge Notices (PCN) also known as parking fines can be issued by Civil Enforcement Officers (CEOs) when parking restrictions aren’t followed. The aim of Civil Parking Enforcement is to make sure parking restrictions are followed so that fewer vehicles are parked illegally.

What personal information we collect

We collect personal information to make sure that we can carry out our work. The personal information we collect includes:

  • Address
  • Telephone number
  • Email address
  • Medical records
  • Disability details
  • Criminal or offending data
  • Vehicle registration

  • Service users

How we use personal information

We use your personal information to:

  • Maintain accounts and records
  • Administer the collection of payments and fines
  • Prevent and prosecute crime
  • Enforce regulatory powers
  • Process applications, requests and appeals
  • Undertake investigations and audits

Why we use your personal information

We are required by law to enforce parking policies throughout the borough. This is detailed in legislation and guidance including:

  • Road Traffic Regulations Act 1984
  • Road Traffic Offenders Act 1988
  • Traffic Management Act 2004

We are allowed to process personal and sensitive data for the following reasons under the General Data Protection Regulation (GDPR) Articles and the Data Protection Act:

  • Comply with a legal obligation or statutory function
  • For legal proceedings (obtaining advice or defending legal rights)
  • Where there is substantial public interest

  • Debt recovery or bailiffs
  • Driver and Vehicle Licensing Agency (DVLA)

  • The Traffic Penalty Tribunal
  • The Traffic Enforcement Centre

When we make an automated decision about your personal information

This service doesn't make any decisions using computers or programmes that don't involve a human being when using your personal information.

How long we keep your personal information

We keep your personal information collected as part of this process for a minimum of 6 years from the date of collection, or for an additional length of time if necessary.

When we transfer your personal information beyond the European Economic Area (EEA)

This service doesn't transfer your information outside the EEA.
